Trustee Protection

Trust Administration Guidance

Kimberly offers meticulous oversight and guidance for trustees regarding legal obligations and compliance with Trust requirements. Florida law does not require a Trustee to hire an attorney to represent them, but Trustees have the right to have legal representation. Kimberly consults with Trustees after the death of a Grantor who created the Trust to advise the Trustee regarding steps they need to take to comply with Florida law. Some Trustees need Kimberly to provide a tremendous amount of legal assistance, and others need only to be basically pointed in the right direction by her, depending on the specific facts, the nature of the beneficiaries, and the complexities of the Trust. Kimberly prepares many types of documents related to Trusts, including but not limited to, Resignation of Trustee and Acceptance of Successor Trustee, Certificate of Trust, Notice of Trust, Trust Distribution Agreements, Trustee’s Distributive Deeds, and required notifications to Trust beneficiaries.
